Wah! SMARTDEALS Copyright and DMCA Notice
Effective date: October 7, 2026
WahSmartDeals LLC ("Wah!", "we", "us") respects the rights of copyright owners. This notice explains how to tell us about content on the Wah! platform that you believe infringes your copyright, and how a person whose content was removed can respond. It applies to content that people upload or post, such as deal images and videos, review photos and comments, profile pictures, business logos and business replies. It should be read with the Customer Terms, Vendor Terms and the Community and Review Guidelines.
1. Where to send a notice
Send notices of claimed infringement to our designated agent:
Copyright Agent, WahSmartDeals LLC
13235 Affirmed Avenue, Frisco, TX 75035, United States
Email: admin@wahsmartdeals.com
2. What a notice must contain
To be effective under 17 U.S.C. § 512(c)(3), a notice must be in writing and include:
- A physical or electronic signature of the copyright owner or of a person authorized to act for the owner.
- A description of the copyrighted work you say has been infringed.
- A description of the material you say is infringing and where it is on the Platform (for example the deal name, the business name, and a link or screenshot), with enough detail for us to find it.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act for the owner.
Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing may be liable for damages. If you are not sure whether something infringes, you may wish to talk to a lawyer first.
3. What we do with a notice
When we receive a complete notice, we may remove or disable access to the material and tell the person who posted it. We may share the notice, including your contact details, with that person. Notices that are incomplete may not be acted on.
4. Counter-notice
If your content was removed and you believe that was a mistake or that you have the right to use it, you may send a counter-notice to the same address. Under 17 U.S.C. § 512(g)(3) it must include:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed because of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district where you live (or, if you are outside the United States, any judicial district in which Wah! may be found), and that you will accept service of process from the person who sent the original notice.
If we receive a valid counter-notice, we will send it to the person who filed the original notice. If that person does not tell us within 10 business days that they have filed a court action, we may restore the material no sooner than 10 and no later than 14 business days after we receive the counter-notice.
5. Repeat infringers
It is our policy to end the accounts of users who are repeat infringers, in appropriate circumstances. Wah! staff can hide or remove content and can deactivate or close an account.
